Lasting Power of Attorney –  Property & Affairs – Personal Welfare
           

  • The importance of making a Lasting Power of Attorney cannot be over stressed since none of us knows when something may happen which makes it impossible for us to deal with our own financial affairs.
  • By making a Lasting Power of Attorney you have the reassurance that if you become unable to deal with your own affairs, or make decisions regarding your personal welfare, they will be dealt with, immediately the need arises, by someone you have chosen.  Furthermore, you can give them guidance as to your wishes in such a document.
  • If you have not made an appointment for property and affairs, your nearest and dearest have to make an application to the Office of the Public Guardian for a Deputy to be appointed.  This is a complicated process; it takes several weeks to complete at a time which may well be traumatic enough and all this red tape can be avoided by this one step.

Living Will / Advance Directive

  • Some people wish to make a Living Will, which sets out their wishes, should their health deteriorate severely. This can specify the treatment they wish to be given or for example, if the time has come where they have a terminal illness, they want to have their dignity preserved and have relief from pain, but that no treatment is to be given to prolong life unnecessarily.

Liability for Nursing Home / Care Home Fees and recovering fees wrongly assessed/paid
